| dc.description.abstract | Las personas que han sido juzgadas y condenadas por un delito, tienen derecho a las garantías
judiciales y contar con el debido proceso, el derecho a la igualdad, entre otras. Así pues, el
derecho a la doble conformidad en el proceso penal, se encuentra consagrado en el artículo 29 de
la Constitución Política de 1991. Se aplica cuando una persona es condenada por primera vez y
su sentencia puede ser apelada y revisada por otro magistrado diferente al que dictó el primer
fallo, ya que cada juez es una instancia diferente. En este sentido, la Corte Constitucional, ha
emitido varias sentencias al respecto, entre las que se encuentra la C-792 de 2014, que inicia las
pautas que ha venido dando esta Corporación acerca del manejo de la doble conformidad,
afirmando el derecho que existe a impugnar los fallos condenatorios impuestos por vez primera
en el marco de la segunda instancia de los procesos penales. Así que la Corte Suprema de
Justicia, a partir de la Sentencia SU-146 de 2020, ha dictado providencias aplicando el derecho a
la doble conformidad de diversas personas que lo han solicitado, tomando como precedente dicha sentencia. Incluso, la Corte Constitucional en varias de sus sentencias de unificación, ha
exhortado al Congreso de la República para que legisle acerca de este derecho. | spa |

| dc.description.abstractenglish | People who have been tried and convicted of a crime have the right to judicial guarantees and to
have due process, the right to equality, among others. Thus, the right to double conformity in
criminal proceedings is enshrined in article 29 of the 1991 Political Constitution. It applies when
a person is convicted for the first time and his sentence can be appealed and reviewed by a
different magistrate. to the one who issued the first ruling, since each judge is a different
instance. In this sense, the Constitutional Court has issued several judgments in this regard,
among which is C-792 of 2014, which initiates the guidelines that this Corporation has been
giving about the handling of double conformity, affirming the right that exists to challenge the
convictions imposed for the first time in the framework of the second instance of criminal
